OFFICIAL CONTEST RULES

*MUST BE 19 YEARS OR OLDER TO ENTER*

These are the official contest rules (“Official Rules”) for the Harvest Wines and Spirits “Life is GRAND with Delivery” contest (the “Contest”). The Contest begins on July 5, 12:00PM AST, 2021 (the “Official Start Date”) and all entries must be made on or before November 28, 11:59PM, 2021.

1. ELIGIBILITY. To be eligible, you must: (i) be a resident of a resident of Nova Scotia; (ii) be 19 years of age or older as of the Official Start Date; and (iii) have submitted an Eligible Entry during the Eligible Period (an “Eligible Entrant”). The “Eligible Period” is the period between July 5, 12:00PM AST, 2021 and November 28, 11:59PM, 2021 (“Contest Closing Date”).
2. EMPLOYEES. You are not eligible to enter or win, if you are: (i) an employee of Micco Companies Limited (the “Sponsor”), its affiliates, or any of its advertising or promotional agencies; or (ii) a member of the immediate family (defined as parents, siblings, children, and spouse, regardless of where they live) or household (whether related or not) of any of the above persons.
3. PRIZES.
   • GRAND PRIZE: There is one (1) prize of $100,000 (the “Grand Prize”) available to be won at the end of the Contest. The chances of winning depend upon the number of Eligible Entries received during the Eligible Period.
   • SECONDARY PRIZES:
     • Weekly Prizes: three (3) prizes consisting of a $50 Harvest Wine and Spirits gift card and one (1) prize consisting of a $50 Harvest Wine and Spirits gift card and a “Clearwater Dinner & Drinks for two” (which includes two live or cooked premium lobsters (1.25 lb – 1.45 lb average each), two lobster bibs and two plastic picks (approximate value $45-$50) (the “Weekly Prizes”) available to be won each week.

The chances of winning depend upon the number of Eligible Entries received between the Official Start Date and the end of the applicable Weekly Prize Period (see the end of these Official Rules for prize schedule); and

• • • Monthly Prizes: five (5) prizes:

• • • • one (1) prize consisting of a $200 Harvest Wine and Spirits gift card and delivery for a year, consisting of free delivery within Nova Scotia for online orders from Harvest Wines and Spirits (approximate value $510). Delivery for a year is based on delivery (anywhere in Nova Scotia) once a week for one year or a total of 52 deliveries;
      • four (4) “food & beverage experience” prize consisting of a tour and tasting followed by a lunch or dinner for 4 at a local Nova Scotia brewery or winery (approximate value $500) (Travel to and from the location is not included) (Each “Monthly Prize”).

The chances of winning depend upon the number of Eligible Entries received between the Official Start Date and the end of the applicable Monthly Prize Period (see the end of these Official Rules for prize schedule).

Prizes must be accepted as awarded. Sponsor reserves the right to substitute the prizes or any part for a prize of equivalent retail value if the above prize cannot be awarded as described for any reason.

4. HOW TO ENTER.

An “Eligible Entry” is an entry into the Contest made by an Eligible Entrant as a result of either (i) visiting Harvest Wines and Spirits website (https://www.harvestwines.ca/) and completing an online order for products of at least $25.00 (before taxes) including without limitation payment of all amounts due before delivery (an “Eligible Purchase”); or (ii) submitting a written entry describing in no less than 500 words “the benefits of purchasing Harvest Wines and Spirits products online vs. in-store” (a “Written Submission”). The following do not qualify as an Eligible Purchase: purchase of gift cards online; orders made through a 1 hour delivery service; or orders made by telephone for curbside pick-up from Harvest Wines retail store location.

• • ONLINE ORDERS: All customers who are Eligible Entrants will receive one (1) entry into the draw for a chance to win a Prize for each Eligible Purchase made during the Eligible Period. The registered account holder associated with the account that completed the Eligible Purchase will be the individual entered into the Contest. Limit of one (1) ballot entry per day, per customer during the Eligible Period.

• • NO PURCHASE NECESSARY: To enter the Contest without making a purchase, print your name, address, email, and telephone number and deliver a Written Submission to the head office location (741 Bedford Highway, Halifax, Nova Scotia) and comply with the entry requirements of these Official Rules*. Limit of one (1) no-purchase ballot entry per day during the Eligible Period. Entrants cannot submit Written Submissions that are duplicated or reproduced, and each Written Submission must be unique and the original work of the entrant submitting it.  Sponsor reserves the right to reject any Written Submission it determines violates these Official Rules, in its sole discretion.

All entries to the Contest become the property of Sponsor. Entrants who have registered through fraudulent means or have provided false or misleading information will be disqualified. 

5. WINNER SELECTION.
   • WEEKLY DRAWS. Eligible Entries received from the Official Start Date to the end of each Weekly Prize Period will be entered into the applicable weekly prize period draw (each a “Weekly Prize Period”). On each Tuesday following the end of the previous Weekly Prize Period, there will be a random draw for a Weekly Prize. The first Weekly Prize Period draw will be held on July 13, 2021, at the offices of the Sponsor. All Eligible Entries received during the Eligible Period will be entered into the draws for the Monthly Prizes and for the Grand Prize. See the end of these Official Rules for the complete prize schedule.
   • MONTHLY DRAWS. Eligible Entries received from the Official Start Date to the end of each monthly prize period will be entered into the applicable Monthly Prize Period draw (each a “Monthly Prize Period”). On the first Tuesday following the end of the previous Monthly Prize Period, there will be a random draw for a Monthly Prize. The first Monthly Prize Period draw will be held on August 3, 2021, at the offices of the Sponsor. All Eligible Entries received during the Eligible Period will be entered into the draw for the Grand Prize. See the end of these Official Rules for the complete prize schedule.
   • GRAND PRIZE DRAW. All Eligible Entries received from Eligible Period will be entered into the Grand Prize draw. On December 2, 2021, there will be a random draw for the Grand Prize at the offices of the Sponsor.
6. WINNER NOTIFICATION. Within (14) fourteen days of a potential Prize winner being selected for a Prize they will be contacted at the email or telephone number recorded in respect of the entrant’s entry. In order to be declared a Prize winner, the selected entrant must comply with these Official Rules, correctly answer without assistance a mathematical skill testing question and sign a Statement of Compliance, Release and Indemnity Agreement (the “Statement”), in a form satisfactory to Sponsor in its sole discretion that must be completed and returned to Sponsor within ten (10) business days of receipt of the Statement or the Prize will be forfeited. The original copy of the Statement must be returned to Sponsor by the selected entrant (no photocopies or facsimile copies will be accepted). The mathematical skill-testing question to be completed is found on the Statement. Upon verification of the completion and correctness of the Statement, the selected entrant will be declared the Prize winner. Before the Statement will be provided to the selected entrant, the selected entrant must produce a piece of Government issued photo identification to confirm their identity. 
7. If a selected potential Prize winner cannot be reached within fourteen (14) days of the first attempted contact, does not answer the skill testing question correctly or otherwise fails to comply with these Official Rules then the Prize will be forfeited, and another entry will be randomly selected from among the remaining Eligible Entries as per these Official Rules. This process of selecting a Prize winner will be repeated until the Prize has been awarded.
8. RELEASE. By participating in this contest, all entrants declare that they have read, understood, and complied with these Official Rules and agree to abide by all decisions of Sponsor whose decisions shall be final and binding in all respects. ENTRANTS AGREE TO RELEASE AND HOLD HARMLESS SPONSOR, ITS AFFILIATES (“RELEASED PARTIES“) AND THE SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS OF THE RELEASED PARTIES FROM ANY CLAIM, LOSS, EXPENSE OR OTHER LIABILITY ARISING FROM PARTICIPATION IN THIS CONTEST OR THE AWARDING, ACCEPTANCE OR USE OF ANY PRIZE AWARDED UNDER THE CONTEST.
9. PERSONAL INFORMATION. By entering the Contest and voluntarily providing your personal information as described in these Official Rules, you agree to the collection, use and disclosure by Sponsor and its respective employees and/or authorized agents of your personal information for the purpose of administering the Contest, including—but not limited to—contacting you with respect to the Contest if you are a selected entrant. Personally, identifiable information will only be used to administer the Contest and for no other purpose
10. Sponsor shall have the right to publicize a Prize winner’s name, photograph, likeness, and village/town/city in association with this Contest. The Grand Prize winner shall make themselves available for photographs for this purpose.
11. ACCOUNT HOLDER. In the event of dispute over the identity of the potential Prize winner, an Eligible Entry will be declared as entered by the authorized account holder of the account used to submit the Eligible Entry, and the potential Prize winner may be required to provide identification sufficient to show that they are the authorized account holder. It is the sole responsibility of entrants to notify the Sponsor in writing if the entrant changes their e-mail address or any other contact information during the Contest Period. The sole determinant of the time for the purposes of a valid entry in this Contest will be the Sponsor’s Contest server machine(s).
12. LOST ENTRIES. No responsibility is assumed by Sponsor for any lost, late or misdirected entries, or for any computer, online, or technical malfunction that may occur.
13. GENERAL. If for any reason the Contest cannot be executed as planned, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right, at its sole discretion, to disqualify any entrant who tampers with the entry process and/or to cancel, terminate, modify, delay or suspend the Contest in its entirety. In the event it is determined that an entrant has entered in a fashion not sanctioned by these Official Rules and/or has submitted more than the number of entries permitted by these Official Rules, all of the entries submitted by the entrant will be disqualified. If any provision contained herein is determined to be void, invalid or otherwise unenforceable by a court of competent jurisdiction, such determination shall not affect the remaining provisions contained herein.
14. GOVERNING LAW. This contest is governed exclusively by the laws of Nova Scotia, Canada, and all disputes are subject solely to the courts of Nova Scotia without regard to conflicts of law.
